Montgomery County Retirement Asset Lawyers

Retirement assets are an important part of your future life during marriage and after divorce. Retirement assets can include government pensions, such as pensions under the Civil Service Retirement System (CSRS) or Federal Employees Retirement System (FERS), private pensions, and retirement accounts, such as 401k plans and IRAs. Meiselman Helfant & Wills will help you to understand these valuable assets and how a court may divide them in a divorce. Unlike most marital assets owned by a party, which cannot be transferred from one spouse to the other, retirement assets can be transferred by the court from one spouse to the other.

Retirement assets are usually transferred from one spouse to the other by a court order. The court order has different names. For private pension plans, retirement assets are usually transferred through a Qualified Domestic Relations Order or QDRO. For federal government pension plans, the Order is called Court Orders Acceptable for Processing (COAP).

You’ve worked your entire life to acquire these assets and invest your hard-earned money to set up the retirement phase of your journey. You should know and understand the impact that a divorce could have on your retirement assets and the effect that a division of your retirement assets may have on your retirement plan.

Meiselman Helfant & Wills has significant experience representing individuals who own significant retirement assets, survivor annuities, and other resources, such as stock options, that are treated similar to pensions during a divorce. We have represented individuals who have federal government pensions, State pensions, private pensions, and stock options.
